SC decision – case of removing 370 from Jammu and Kashmir will not go to larger bench

New Delhi, Mar 02 (HS): The Supreme Court gave an important ruling on the Abrogation of article 370 in  Jammu and Kashmir and ruled it  will not go  the larger bench. In the Supreme Court, the Constitution Bench of Justice NV Ramanna, Justice Sanjay Kishan Kaul, Justice R Subhash Reddy, Justice BR Gavai and Justice Suryakant have given this ruling . 23 petitions were to be heard challenging the Abrogation of Article 370 .

Supreme Court refused to refer to a larger bench a batch of pleas, challenging the constitutional validity of Centre’s 5th August 2019 decision of abrogating provisions of Article 370.

In fact, the petitioners, citing two separate and contradictory rulings of the five-judge Constitution Bench had demanded that the matter be referred to a larger bench. While hearing this, the 5-judge constitutional bench headed by Justice NV Ramanna reserved the verdict on 23 January.

The central government has opposed the petitions. The Center argues that removing Article 370 was the only option to change the situation in Jammu and Kashmir. In this case, the Supreme Court had heard the arguments of all the parties and reserved the decision when the matter was sent to a larger bench.
