New Delhi,July 17(HS)The Congress says it is the winner.So does the rival BJP.Is there no loser in Karnataka rebel case for which interim order was given by the Supreme Court on Wednesday?
It has puzzled the common men.How can it be?Even a cricket world cup match does not remain undecided.A winner is declared through one rule or the other which may appear strange to some.
Host England was declared a winner last Sunday on the basis of boundaries scored during the match (entire)when two super overs, too,had failed to decide it.
So,how can both the sides claim a win in a court case?Either has the Congress got the interim order wrong or the BJP.First a close look at their statements and history.In a tweet,the Congress says,”operation Lotus(BJP symbol) has failed. Satyamev Jayate”.It has fallen on deaf ears of BJP leader B S Yeddyurappa.”The BJP has achieved a moral victory”,claims he.
Now the history part.Some ruling party Assembly members in the southern state were unhappy with their leaders and revolted against them this month.They decided to resign from the House in protest.
As the Speaker was not immediately available they sent their papers to his office.It appears so simple.But it was not found so on technical grounds.The resignation has to be submitted in a proper format.
The time gap was used by the ruling parties to their own advantage.These parties,the Congress and the JDS, met separately and issued whip to party members to be present in the House and support the coalition government whenever required.
To rebels,it was aimed at disqualifying them, taking refuse in the tenth schedule of the Constitution (anti-defection law)which was added to the Constitution, a long time ago( in 1985).
This law disqualifies a member if he or she disobeys the whip and votes according to conscience.The rebels saw through the game and went to the apex court,finding no other alternative.
The Court has given its verdict.It has said that they are free to go to the Assembly if they so desire.They cannot be forced to vote.
To common men,it means that they can disobey the whip and go by their conscience.If they want to vote against the coalition government they can do so.They have also been allowed to absent themselves.This also may go in favour of the opposition.How does it benefit the Congress ?
The rebels number 15.If all of them do not attend the House the day the motion is taken up the strength of the Assembly will come down to 209.The BJP has 105 members which is more than half the total number and enough to win the no-trust motion.
The coalition can succeed only if it wins over some of them.May be the Congress has plan B ready.It can be known only on Thursday (tomorrow).At present,however,there appears to be no reason for the party to rejoice.
