SC rules against mother’s custody request for Bengaluru engineer’s son

The Supreme Court recently refused to grant custody of Bengaluru engineer Atul Subhash’s minor son to his mother, Anju Devi. A bench led by Justice Bela M Trivedi cited that the child’s grandparents were strangers to him. The court clarified that Anju Devi could meet the child if she wished, but she would need to follow a specific procedure for that.

The case revolves around the tragic death of Atul Subhash, who took his life on December 9, 2024. Atul’s mother, Anju Devi, filed a petition seeking custody of her grandson. She claims that no one knows the whereabouts of the child, as Atul’s wife, Nikita Singhania, has not disclosed his address. Following this, Atul’s brother-in-law Anurag Singhania and mother Nisha Singhania were arrested and are currently in custody.

On December 20, 2024, the Supreme Court issued a notice to the governments of Uttar Pradesh, Haryana, and Karnataka while hearing Anju Devi’s petition. The court’s decision emphasizes the importance of the child’s well-being and the complexity of custody matters, especially when extended family members are involved.
