Nirbhaya convicts move to court seeking stay on their execution..
New Delhi, Jan 30 (HS): The four convicts of the Nirbhaya’s gang rape cum murder case has now moved to the court seeking stay on their execution, saying legal remedies of some of them are yet to be availed.
The lawyer for death row convicts on Thursday filed a plea in Patiala House court saying that according to the Delhi Prison rules, none of the four convicts in the same crime can be hanged till the last convict has exhausted all legal options including the mercy petition. The special judge AK Jain said that the matter would be heard later in the day.
A court had earlier in January issued black warrants for the second time for the execution of all the four convicts, Mukesh (32), Pawan Gupta (25), Vinay (26) and Akshay Kumar Singh (31), in Tihar jail at 6 am on February 1. Earlier, the court had fixed January 22 at 7 AM, as the hanging date but was later changed following a curative petition filed by one of the accused.
Nirbhaya, the 23-year-old paramedic student was gang-raped and brutally assaulted on the intervening night of December 16-17 in 2012 on a moving bus in south Delhi by six persons before being thrown out on the road. She was accompanied by her male friend who also sustained injuries in the incident.
Both were later taken to the AIIMS by the police, where Nirbhaya succumbed to her injuries after some days.
