Nirbhaya case: Hearing on plea for hanging the culprits postponed
New Delhi, Dec 13 (HS): Hearing in Patiala House Court in the Nirbhaya gangrape case has been postponed. On the demand for issuing death warrants of the convicts, the judge said that I have received information from the Supreme Court that Akshay’s reconsideration petition has been accepted and will be heard on December 17. Now the matter will be heard on December 18.
Due to security reasons, the four convicts were presented in court through video conferencing. During the hearing of this case, Nirbhaya’s lawyer said that the date of execution should be fixed. The issuance of mercy petition has nothing to do with the issue of the death warrant. Death warrants cannot be stopped to apply for mercy petition.
Nirbhaya’s lawyer said that if the Supreme Court is going to hear the review petition, then they can postpone or stay the death warrant. The reconsideration of the remaining three convicts has been dismissed. They do not have the right to file the petition.
On this, the judge said that as long as the reconsideration petition is pending in the Supreme Court. Till then this court cannot issue a death warrant. Nirbhaya’s lawyer referred to the Yakub Memon case. On this, the judge said that no reconsideration petition was pending in the Yakub Memon case.
Nirbhaya’s mother blamed the system for waiting for justice for seven years. Nirbhaya ‘s mother also expressed anger at the acceptance of Akshay’s reconsideration petition.
