INDIA Bloc plans impeachment move against Allahabad HC Judge Shekhar Yadav in LS & RS
The opposition INDIA bloc is moving forward with impeachment proceedings against Allahabad High Court judge Shekhar Kumar Yadav. This follows a controversial speech he made at a Vishwa Hindu Parishad (VHP) event on December 8, where he allegedly targeted minorities. The opposition aims to introduce notices in both the Rajya Sabha and Lok Sabha by Thursday. Nearly 40 MPs from various parties, including Congress, TMC, CPI(M), and RJD, have signed a petition in the Rajya Sabha.
Under the Judges (Inquiry) Act, 1968, a notice will be considered once it gathers at least 50 signatures. Efforts in the Lok Sabha are also gaining momentum, with Congress and TMC MPs supporting the move. The charges against Yadav include hate speech and spreading communal discord through his remarks at the VHP event, which were held on the Allahabad High Court premises.
Yadav’s speech included claims that India would function according to the will of the majority, stating that the law works based on the majority. He also allegedly used derogatory language against the Muslim community and endorsed political positions of the VHP. These actions, the petitioners argue, disqualify him from serving as an impartial judge, as required under Article 14 of the Constitution.
In the Lok Sabha, at least 100 signatures are needed for the petition to be considered, and if the motion proceeds, a three-member committee will be formed to investigate the charges. The committee, which will include a Supreme Court judge, a high court chief justice, and a distinguished jurist, will report back with findings on whether Yadav’s behavior justifies his removal.
The Supreme Court has already taken notice of Yadav’s remarks and sought details from the Allahabad High Court. The Bar Council of India has also condemned his comments. The investigation continues as the opposition pushes for action.
