High court orders to reinstate dismissed policemen related to Khajurbani hootch tragedy

Chapra/Gopalganj,14 January,2021 (HS) Patna  High court has ordered to reinstate dismissed policemen and has ordered to pay them salary from the time of illegal dismissal. Other benefits will also be given to them. Hearing the writ petition of Ananjay Singh, who was posted as arms guard at Gopalganj town police station, Justice Chakradhari Singh has set aside the dismissal order of the then Director General of Police Gupteshwar Pandey terming it illegal order with an aim to diffuse to boiling tension of people following sixteen deaths due to consumption of spurious liquor. Justice has observed that the order was not in accordance with Bihar Police Mannual Rule.

 Neither framing of charge was proper nor individual evidence was solicited. Proper procedure was also not followed. Hence the order P of the DGP is set aside. With this order Sub Inspector Amit Kumar, Munshi Gulam Muhammad, Arms guard Ananjay Kumar and two others have got relief.
DGP had dismissed 21 policemen on the recommendation of Saran Range DIG which included three Sub Inspectors, five Jamadars, and others. Others too, have gone before Patna High court for relief.and their judgement is awaited.
Dismissed policemen include Nawal Kumar Singh, Siwan, PTC constable Pushpendra Ojha, Dineshwar Yadav, Gopalganj, Moham Prasad Singh Banka, Dhiraj Rai Gopalganj, Shailendra Kumar Arwal, Manoj Kumar Jahanabad, Ananjay Kumar Buxar, Nitesh Kumar, Patna, Vishvajit Kumar Saran, Murli Yadav, Gopalganj, Manish Kumar Saran, Rakesh Kumar Singh, Saran and Rahul Kumar, Gopalganj.
In hootch tragedy at Khajurbani under Gopalganj town police station in the year 2016 in the month of August, 19 persons had died. After the incident, raid was conducted at Khajurbani and illicit liquor in huge quantity was recovered. Police had lodged two separate FIRs with Gopalganj town police station. Barring the main accused, all other accused were sent to jail. Police had submitted final report with the court.
